(b) UNO‘ as Processor: when a client company uses B2B modules (for example, time tracking/absences) and enters data of its employees or other internal data, the client company acts as Data Controller and UNO MAS UNO VENTAS, S.L. acts as Data Processor, in accordance with a Data Processing Agreement (art. 28 GDPR).

4. Purposes of processing

1.Manage purchases, delivery, invoicing and customer service.

2.Manage registration, access and use of the SaaS platform associated with NFC cards and the contracted modules.

4.Prepare usage statistics and service improvement (preferably in aggregated form).

5.Send necessary service-related communications: technical notices, relevant changes, incidents and invoicing.

6.Send commercial (marketing) communications when there is a valid legal basis and always with an opt-out option.

5. Legal bases (art. 6 GDPR)

●Performance of a contract or implementation of pre-contractual measures: purchase, registration and provision of the service.

●Compliance with legal obligations: invoicing, accounting/tax obligations and handling of claims.

●Legitimate interest: service security, abuse prevention and basic improvements (after a balancing test).

●Consent: (i) non-essential cookies, (ii) commercial communications where consent is required, (iii) transfer to third parties for advertising purposes if expressly enabled.

6. Use of data for advertising and/or commercial purposes

UNO‘ may use certain contact data for commercial purposes only under the following terms. Option A is recommended due to lower regulatory exposure.

Option A (recommended): UNO‘ will send its own commercial communications only if the user gives express consent (opt-in checkbox) or when there is a prior contractual relationship and the communication refers to similar products/services, always offering a simple and free opt-out mechanism.

Option B (only if enabled and with separate consent): Disclosure of data to collaborating third parties for their own commercial campaigns, exclusively with express, separate and unequivocal consent, informing about categories of recipients and allowing consent to be withdrawn at any time.

Suggested checkbox (opt-in): “I wish to receive commercial communications from UNO‘ by electronic means.”

Suggested checkbox (third parties, if enabled): “I wish to receive commercial offers from UNO‘ collaborating third parties. I may withdraw my consent at any time.”

7. Recipients and processors

The data may be disclosed to:

●Suppliers necessary for the provision of the service (for example, hosting/servers in Spain, payment gateway, courier services, technical support, transactional email), acting as processors under contract (art. 28 GDPR).

●Public administrations and competent authorities when there is a legal obligation.

●Third parties selected by the user through links or integrations (for example, social networks), which will act as independent controllers.

8. International data transfers

As a general rule, data are hosted in Spain. If third-party services involving transfers outside the European Economic Area (EEA) are used, UNO‘ will apply appropriate safeguards (for example, standard contractual clauses, adequacy decisions or other mechanisms provided for in the GDPR).

9. Retention periods

●Customer/purchase data: during the contractual relationship and, thereafter, for the legally established limitation and accounting/tax retention periods.

●Account data: while the account remains active; after closure, only the strictly necessary data will be blocked/retained for legal obligations or for the defense of claims.

●Data processed as Processor (B2B): in accordance with the instructions of the Controller and as set out in the DPA.

10. Data subject rights

The data subject may exercise the rights of access, rectification, erasure, restriction, portability and objection, as well as withdraw consent, by sending a request to info@unotap.es or info@unotap.eu. In case of disagreement, a complaint may be lodged with the Spanish Data Protection Agency (AEPD).

11. Security measures

UNO‘ applies reasonable technical and organizational measures aimed at ensuring the security, integrity and confidentiality of data (for example, access control, customer-level segregation, encryption in transit, backups and activity logs), in accordance with a privacy by design and by default approach.

Returns and withdrawal policy (online sales)

1. Scope

This policy applies to purchases made on unotap.es/unotap.eu by consumers. For business-to-business (B2B) purchases, specific conditions may apply.

2. Right of withdrawal (consumers)

The buyer has 14 calendar days from receipt of the product to withdraw from the purchase, without giving any reason, in accordance with consumer protection regulations, except for the exceptions indicated in the following section.

3. Exceptions (personalised products)

The right of withdrawal does not apply to goods made according to the consumer’s specifications or clearly personalised. If the NFC cards are printed, engraved or configured specifically for the customer (for example, with name, logo or design), they will normally be considered a personalised product.

Suggested clause: “As this is a personalised product made to order, once production has started, withdrawal will not be accepted, except in the case of manufacturing defects or lack of conformity.”

4. Return procedure

To request a return or exercise the right of withdrawal, the buyer must send an email to info@unotap.es (Spain) or info@unotap.eu (EU), indicating at least the order number, date, product and contact details. UNOTAP will confirm the return instructions and address.

5. Condition of the product

The product must be returned in perfect condition, with its original packaging whenever possible, and without any use beyond what is necessary to verify its nature, characteristics and functioning.

6. Refunds

Once the return has been approved, the refund will be made using the same payment method, within the legally established time limits. Return shipping costs will be: [paid by the customer / covered by UNOTAP in the event of a defect].

7. Defective product or lack of conformity

If the product has a manufacturing defect or does not correspond to the order, UNO‘ will bear the reasonable costs of replacement or repair, or a refund, as appropriate.
